Having read to, and left with, Japanese Naval Authorities reply in accordance with instructions contained in your communication number 1040/10 dated 5th June, to paragraph 13 of memorandum, which they looked upon with the greatest importance. They said they could not agree that British Ships chartered to Chinese and therefore flying the British flag, but obviously assisting Chiang Kai Shek, could be looked upon as British ships carrying on peaceful trade. In this connexion Japanese Government statements on August 26th and September 5th 1937 refer.
